DMCA and copyright

Truffle's Town is operated by TRON Technologies LLC ("Truffle's Town", "we", "us"). We respect copyright, and this page explains how to tell us if you believe something in the game or on trufflestownapp.com infringes your rights, and what happens after you do.

1. What this covers

Truffle's Town has no user accounts, no uploads, no chat, and no user-generated content, so there is nothing for a player to post. In practice a notice under this page will be about the game's own material: its artwork, music, text, characters, or the content of this website.

If you believe we have used your work without the right to, we want to know. Tell us and we will look into it properly rather than ignore it.

2. How to send a notice

Send your notice to our designated agent, in writing, at the address in section 4. To be effective under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), it needs to include all of the following:

  1. A physical or electronic signature of the copyright owner, or of a person authorized to act on their behalf.
  2. Identification of the copyrighted work you say has been infringed. If you are covering several works in one notice, a representative list of them.
  3. Identification of the material you say is infringing, described specifically enough for us to find it. Tell us where it appears: a screen or feature of the game, or a page and position on the website.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on their behalf.

An incomplete notice may not be effective, and it will slow us down. If yours is missing something we will tell you what.

3. What happens next

We will acknowledge your notice, review it, and act on valid ones. Depending on what the notice is about, that can mean removing or replacing the material in the next update of the game, taking it off the website, or removing it from a store listing. We may pass your notice on to the app store concerned where the material sits in a store listing rather than in the game itself.

We may share a copy of your notice, including your contact information, with the person or party who supplied the material at issue, so that they can respond.

Email reaches us fastest. Please put "DMCA notice" or "DMCA counter-notice" in the subject line.

5. Counter-notice

If material of yours was removed and you believe that was a mistake, or that you are authorized to use it, you can send a counter-notice to the same agent. Under 17 U.S.C. § 512(g)(3) it needs to include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the district in which your address is located, or, if your address is outside the United States, of any judicial district in which we may be found, and that you will accept service of process from the person who sent the original notice or their agent.

We may send your counter-notice to the person who filed the original notice, and we may restore the material if they do not tell us within ten business days that they have filed a court action.

6. Repeat infringers

We end access for repeat infringers in appropriate circumstances. Because Truffle's Town has no accounts and no uploads, this applies mainly to anyone supplying material to us.

7. A warning about false claims

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages, including costs and legal fees. Please make sure the material is really yours and that the use is really unauthorized before you send a notice.

This page describes how to reach us and what we do with a notice. It is not legal advice. If you are unsure whether you hold the rights you are asserting, or whether a use is permitted, talk to a lawyer.
